Returning to India after working abroad often leaves a pension, superannuation balance, or overseas retirement account behind. Under the Foreign Exchange Management Act, 1999 (FEMA), there is no single rule: the answer depends on what the benefit is, when it was earned and where you want to receive it.

Two provisions do most of the work: the Resident Foreign Currency (RFC) account under the Foreign Exchange Management (Foreign Currency Accounts by a Person Resident in India) Regulations, 2015 (FEM (FCA) Regulations), and Section 6(4) of FEMA, read with the Reserve Bank of India (RBI) Master Direction – Deposits and Accounts.

What is FEMA Bytes?

FEMA Bytes is a biweekly, compliance-focused knowledge initiative by Solique, built on extensive expertise in transaction advisory and foreign exchange laws. Each edition distills a specific topic under FEMA, along with its allied regulations, into a structured and practical reference.

Designed for business owners, leadership teams, and individuals, FEMA Bytes aims to simplify complex regulatory concepts and enable informed decision-making in cross-border transactions with clarity and confidence.

6. What paperwork do I need?

Document / RequirementPurpose
Passport and Travel RecordsSupports FEMA residential status and the date it changed (AD bank due diligence)

Evidence of Date and Manner of AcquisitionShows assets were acquired while non-resident (supports Sec 6(4) position)
Indian and Overseas Tax RecordsWhere needed for tax or treaty relief (tax compliance)

7. Practical do’s and don’ts

DoDo not
Fix your FEMA residential status, and the date it changed, before choosing an account route.Assume income-tax residence and FEMA residence are the same.
Identify exactly what each benefit is: employer pension, superannuation, provident fund or personal account.Treat every foreign pension or retirement scheme alike.
Check RFC eligibility with your AD bank before giving the administrator new bank details.Credit a receipt to an RFC account without confirming it is a permitted credit.
Tell your bank about your change of status and re-designate NRE / NRO accounts.Continue to operate NRE or NRO accounts as a non-resident after you return.
Keep evidence that overseas accounts and assets trace back to your non-resident years.Top up overseas retirement accounts from India on the assumption that Sec 6(4) covers it.
Review Indian taxability and foreign-asset disclosure separately.Assume a 7-day or other repatriation deadline applies, or that FEMA permission means no tax.

Note on tax: This FEMA Bytes covers FEMA only. A foreign pension or retirement withdrawal carries separate income-tax and foreign-asset disclosure implications, and FEMA permission does not mean no tax. Review the tax position with your tax adviser before you move or receive the money.

Navigating FEMA? We’re here to help

A foreign pension is not one rule under FEMA. Whether it lands in an RFC account, in rupees or stays abroad depends on what the benefit is, when it was earned and your residential status on each date. Settle the route with your AD bank before you give the administrator new bank details.
